For your <br />convenience, I have listed the concems in the same number and order as the original adequacy letter dated <br />May 24, 2001. In order to have adequate time for review, I would appreciate a response from you on or <br />before June 14, 2001. Please be advised that your application may be deemed inadequate and may be <br />denied on June 18, 200] unless the following adequacy review items are addressed to the satisfaction of <br />the Division. If additional time is needed to prepare and submit an adequacy response, the applicant may <br />waive their right to a decision within 90 days and request an extension of time. However, such request <br />must be made in writing and will need [o be received by the Division on or before June 14, 2001. <br />6.4.3 EXHH3[T C -Pre-minine and Minine Plan Map(s) of Affected Lands <br />1. Permanent Man-Made Structures. The mining plan map provided indicates mining will occur within <br />200 feet of a number of permanent man-made structures, including the abandoned and plugged oil well <br />structure owned by Machi-Ross Petroleum Company. Prior to mining within 200 feet of the well and <br />pipeline leading to the well, the applicant will need to comply with the requirements of Rule 6.4.J 9. (A <br />wri«en damage waiver or letter of release from Mach-Ross Petroleum Company would be desirable). <br />Please verify. <br />6.4.4 EXHIBIT D -Minine Plan <br />2. The applicant lists on page 2 (item 13.2) of the application form the following items to be used or stored <br />within [he permit area: diesel fuel, grease, hydraulic fluids, concrete additives, and cement. The Applicant <br />also mentions that they may prepare a Spill Prevention Containment & Control Plan if required by either <br />Weld County or the Colorado Department of Public Health & the Environment. Because of [he close <br />proximity of groundwater at the Green/Croissant Property, there is potential for water quality impacts. To <br />ensure protection of groundwater resources, as required by Rule 3.1.6(1), the Division requests that the <br />applicant define what protection measures will be used to ensure the capture of the items listed above in <br />the event of a leak or spill. Submittal of a Spill Prevention Containment R Control Plan following <br />approval by either Weld County or CDPHE would satisfy this requirement. Please respond. <br />
