P 319 472 230 <br />Enclosed is the "Order for Civil Penalty" relative to the Notice of Violation and Cease and Desist <br />Order and Clean Up Order issued December 15, 1992. The Order for Civil Penalty ("Order") <br />requires you to submit payment of the $11,316 penalty within thirty (30) days of receipt of the <br />Order. The basis for the penalty calculation and its imposition is presented in the enclosed <br />"Petition for Imposition of Civil Penalty." <br />Per the Water Quality Control Act, the Water Quality Control Division is required to file a <br />Petition for Imposition of Civil Penalty ("Petition") with the executive director, or her designee, <br />which in this case is me. If [find the penalties acceptable, then the penalty is imposed. I have <br />determined, after review of the Petition, that the penalty is acceptable. The signed Order imposes <br />this penalty. <br />To close out this enforcement action, we ask that a check for $11,316 be submitted within the <br />next thirty (30) days. It should be sent to the Colorado Department of Public Health and <br />Environment, WQCD-PE-B2, 4300 Cherry Creek Dr. S., Denver, CO 80222-1530.
