'Therefore, in lieu of a formal letter, the <br />operator was contacted and agreed [o the stipulations which are explained below. <br />Stipulation # 1 <br />This site is on State Land Board property and as such, the SLR offered a letier to the <br />operator indicating that a final and fully executed lease would be forthcoming once all <br />permitting was completed, including the DMG permit. Since we require a lease to show <br />right-of--entry and the SLB wanted our application approved prior to executing this lease, <br />the npprovnl was stipulated to have the operator submit a copy of the lease prior to permit <br />iss:iunce. Once the lease and performance warranty are received, the permit will be <br />issued. <br />Stipulation # 2 <br />The application alludes to the possibility of drilling and blasting a[ this site if solid <br />granite is encountered below the decomposed granite that is the target of this mining <br />operation. Since it is only a remote possibility that this will occur, ii seemed pointless to <br />submit a geotechnical stability exhibit at this time. Therefore, the permit is being <br />stipulated to state that prior to conducting blasting at this site, the operator must submit <br />and receive approval for a geotechnical stability exhibit (Rule 6.5(4)). In this way, the <br />exhibit will not be prepared unless absolutely necessary. <br />MEMO <br />Both of these items were discussed with the applicant's consultant and he agreed that this <br />would be the best way to handle it. <br />
