Long <br />Division Director <br />I have reviewed the recent exhibit materials you sent in response to my second adequacy review letter. The <br />submitted materials appear to address the questions I had expressed in that letter. <br />Exhibit D -Mining Plan <br />The explanation you provided of the sequence of mining through the phases, the setting up of hatching equipment, <br />scale and statehouse information, and well closure, all meet the requirements of this exhibit. I will use these and <br />other previously submitted information to begin estimating the bond amount. The figures will be sent to you under <br />separate cover prior to the decision date. <br />Exhibit S -Permanent Man-made Structures <br />You have provided a damage compensation affidavit, sigtied by you and notarized, stating that Colorado Gravel <br />Products Inc. assumes all responsibility for repairing any damage incurred by the mining and reclamation operation. <br />This, in addition to an amount of bond money sufficient to cover possible damage, will satisfy the requirements of <br />this exhibit. <br />Additional Items <br />I received the receipt for the recent additional filing with the clerk and recorder, As ahvays, this letter to you and <br />any future correspondence to me will need to be additionally filed, with another receipt obtained and sent to me <br />before the decision date. <br />The Division's decision date is today. Due to the written objection to the application, the Division will simply issue <br />a "recommendation," based on our opinion of whether the application's requirements were met. The Division will <br />send you its recommendation that this application be approved under separate cover. The formal public hearing <br />before the Board, during which the Board will hear our recommendation and make its decision on this application, <br />is scheduled for the May 24-2~, 2000, meeting. You have received a formal notice of that hearing. <br />There will be aPre-hearing Conference held via telephone conference call, at 10:00 a.m., on Monday May 8, 2000. <br />You have received a formal notice of that conference. <br />Thank you for your prompt submittal of the latest adequacy response materials. And thank you for including <br />duplicate copies; I forwarded the second set to our Denver office. <br />
