M-2002-059 Division of Minerals and Cealagy <br />RE: Moffat County Road DepartrnentPRespons to the Division of Minerals and `~ <br />Geology's Adequacv Review Concerns ated July 31, 2002, <br />Addendum to Exhibit D: In Exhibit D (page 2) Moffat County stated that we <br />may put an asphalt batch plant onto the properly for neighborhood paving <br />projects. This was a broad statement that needs clarifying. First of all, Moffat <br />County does not have an asphalt batch plant, and we would employ licensed <br />and qualified contractors with the knowledge and experience necessary to <br />apply all of the safety measures including a Hazazdous Material Spills Policy. <br />As a minimum, the contractors will build dikes and provide lining where <br />necessary to contain at least 110 % of the actual size of the tanks to be used in <br />order to contain any spillage and run-off. All materials that escape will be <br />recycled into the process, no contamination will occur as a result of this <br />operation. Moffat County will commit to a Hazardous Material Spill Policy, <br />which adheres to the following: <br />A reportable spill is a spill of any toxic or hazardous substance (including <br />spills of petroleum products) within the permit azea reportable to any Division <br />of the Colorado Department of Public Health and the Environment, the <br />National Response Center, the Colorado Emergency Response Center, the <br />Colorado Emergency Planning Commission, a local Emergency Planning <br />Commission, a local Emergency Planning Committee, or a State Oil <br />Inspector. The operator shall notify their own office and the office of the <br />Moffat County Road Depanlment of a reportable spill within the permit azea <br />using the same timeframe required by the permit, license, notice, Act, Rule or <br />Regulation governing the reporting of the spill to the appropniate agency. <br />Notice of a reportable spill shall be faxed to: Minerals Program Supervisor, <br />Division of Minerals and Geology, Fax (303)-832-8106. <br />The Fax shall include a call back number of a responsible company official <br />for the DMG staff to use as a contact. <br />2. In response to the Division of Wildlife's comment about staying outside of the <br />100 year flood plain, Moffat County's operation will be on the bench above <br />the flood plain, and will not disturb that area. (See Exhibit C-4) <br />3. Moffat County will modify the seed mix formula on Exhibit E-1 by replacing <br />the intermediate wheatgrass with two pounds pure live seed per acre of <br />Needle-and-thread and three pounds of pure live seed per acre of slender <br />wheatgrass. ~~ ~ n ~~`r 6~ <br />This Response is respectfully submitted by: Billy E Mack (Supervisor) Moffat <br />County Road Department an August 7, 2002 <br />
