The Division of Minerals and Geology required each
operator to submit ground water monitoring plans for their respective
operations. After reviewing those monitoring plans and related data,
the Division is unable to determine whether these operations are having
any affect on your wells.
The Division of Minerals and Geology regulates the extraction of
construction materials under jurisdiction of the COLORADO LAND
RECLAMATION ACT FOR THE EXTRACTION OF CONSTRUCTION MATERIALS (the ACT).
Reclamation performance requirements for water related issues are
outlined in C.R.S. 34-32-116(4)(H), which states:
Disturbances to the prevailing hydrologic balance of the affected land
and of the surrounding area and to the quality and quantity of water in
surface and groundwater systems, both during and after the mining
operation and during reclamation, shall be minimized. Nothing in this
paragraph (h) shall be construed to allow the operator to avoid
compliance with other statutory provisions governing well permits and
augmentation requirements and replacement plans when applicable.
We believe that your complaints are issues involving injury to water
rights and are more appropriately handled by the Colorado Office of the
