Such modifications include the addition of two internal dikes and enlargement of the pond by <br />removing additional material upstream of tfte dam. <br />To the best of my knowledge, based on my professional expertise, Refitse Area Sediment Pond 2/3 at <br />the Deserado mine was constructed in conformance with prudent state-of--the-art construction <br />practices. Further, [he structures were constructed in compliance with the approved design, as <br />specified within Section IV.J of the approved permit documents and depicted on Map 79 and other <br />permit documents or maps as amended from time to time.
