Shelton <br />Director <br />RE: Your mining operation located SE;,NW!;, & N'id!~StJ'~, Sec.33, T. 4N, <br />R 71W 6th P.PI. <br />Dear Sirs: <br />It has come to our attention that you are conducting an unpermitted granite <br />quarry operation located at 7 miles [J.SJ. of Lyons, Colorado. <br />All mining operators including sand and gravel operators are required to <br />obtain mining and reclamation permits for their mining operations in <br />Colorado by the Colorado ?lined Land Reclamation Act, C.R.S. 1973, 34-32-101 <br />et sec., and specifically, 34-32-109(7), as amended. <br />The i`tined Land Reclamation Division has placed you and your operation <br />on the Mined Land Reclamation Board meeting agenda for consideration of <br />possible violation of the above mentioned statute. This meeting is scheduled <br />for September 23, 1981, in Denver, Colorado (at) 9:00 A.~L, Seate Centennial <br />Building, 1313 Sherman Street, Room 110.. <br />At the meeting the Board may issue a Cease and Desist Order far your operation <br />at the above cited location per Article 32 of Title 34, Section 123 (1) and (2) <br />which states: <br />(1) "lJhenever an operator or prospector fails to obtain a valid permit <br />or file a notice of intent under the provisions of this article, <br />the board may issue an immediate cease and desist order. Con- <br />currently with the issuance of such an order, the board may seek a <br />restraining order or injunction pursuant to Section 34-32-124(3). <br />(2) Any operator ivho operates without a permit or a prospector who <br />prospects without filing a notice of intent shall be subject Co <br />a civil penalty of not less than one hundred dollars per day nor <br />more titan one thousand dollars per day during which such violation <br />occurs; except that any operator eligible for a permit under <br />section 34-32-110 shall be subject to a civil penalty of not less <br />than fifty dollars nor more than two hundred dollars per day during <br />which such violation occurs." <br />
