<br />;TdEZ;S, Jefferson County desires to conduct a(n) open mining
<br />operatie~, known as FINE JUNCTION GRAVEL PIT for the purpose of extracting open
<br />wined sand and graveland
<br />WHEREAS, on April 18 , 1978 Jefferson County "FILED" an
<br />appiication,a reclamation plan and map, and the required fee, as required by law; and
<br />Sv'HEREAS, on September 28, 1978 , the *Iined Land Reclamation Boar3 approved
<br />Jefferson County's application and set bond; and
<br />WHEREAS, on September 28, 1978 , the ;fined Land Reclamation Board accepted
<br />surety submitted by Jefferson County and such date shall be considered the
<br />date of issuance of the permit and the anniversary date for all other purposes; ar_d
<br />WHEREAS, the Mined Land Reclamation Board has made a finding, for the purposes
<br />of issuing this permit, that:
<br />1) the application complies with the requirements of the Colorado
<br />'4ined Land Reclamation Acc and all applicable local, state and
<br />Federal laws;. wad, .
<br />2) the operation :-i].1 not adversely affect the stability of any
<br />significant, valuable, and permanent man-made structures located
<br />within t:+o hundred feet of the affected land, except where there
<br />is an agree eat berreen the operator and the persons having an
<br />interest is the structure that damage to the structure is to be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations wad reclamation can be carried out
<br />is cow°oraaace with the requirements of C.R.S. 1973, 34-32-116, 2s
<br />amended (1976 Sess. Laws H.B. 1065); and
<br />WHERE<15, for the purposes of issuing this permit, the operator has made a
<br />satisfactory showing to the Board that he will employ during and after his
<br />open mining operations procedures reasonably designed to minimize
<br />as much as pract'_cable the disruption from the open mining ooerat_cns
<br />and will provide for the rehabilitation of the affected land through the rehabiii:atior.
<br />of plant cover, soil stability, water resources, and other measures appropriate to t!:e
<br />subseoueac beneficial use of such mined and reclaimed lands; and that in the event
<br />c: the failure of his proposed reclamaticn plan, he will take whatever measures wh:;ch
<br />may be necessary in order to assure Che success of reclamation of the lands affected
<br />by his open mining operations; and,
