Cattany <br />Division Director <br />Natural Resource Trustee <br />DMG has completed the preliminary adequacy review of your application fora 110c permit for the North Clear <br />Creek Construction Materials Mine. The application cannot be approved until the following issues are <br />adequately addressed. Please submit a response to the following issues as soon as possible, but no later <br />than August 7, 2006 so the decision due date set for August 7, 2006 can be met. If you cannot respond by <br />August 7, 2006 please submit a written request for extension of the decision date. If your response, or an <br />extension request, are not received by August 7, 2006 this application may be denied. <br />I must apologize for how late in the review period this adequacy review is being issued. An illness in my <br />family took me away from the office for a significant portion of the past three weeks. Cordilleran will most <br />likely need to request the extension noted above to allow adequate time to respond to these adequacy issues. <br />DMG will make every effort to process your adequacy review response in a timely manner so the delay for a <br />decision on this application will be minimized. <br />ADEQUACY ISSUES <br />Exhibit A -Location Mag <br />Please submit an index map with sections indicated, similar to a U. S. G. S. quadrangle, so the <br />location legal description can be verified. It appears the location is in the SW/4SE/4 of Section 36, <br />contrary to that indicated on the application. It appears the location specified in the previous public <br />notices was correct. Please submit verification of the recent publication so DMG can verify it specified <br />the correct location as well. If so, the only revision necessary is to correct Item No. 10 on the <br />application form and any other incorrect reference to the SW/4SW/4 sec. 36 in the application. If any <br />of the public notices indicated the incorrect location, they will need to be re-issued. <br />Exhibit B -Site Description <br />2. Please verify with the Colorado Division of Wildlife that this location does not support any critical <br />habitat for the Greater Sage-grouse and, if applicable, indicate what measures will be implemented to <br />protect this species of concern. <br />Exhibit C -Mining Plan <br />3.
