The applicant must <br />address one additional concern before the North River Gravel Pit Extension can be approved. <br />The applicant identified BLM as the owner of land directly north of the proposed pit. As stated in the <br />Division's letter dated March 26, 1999, surface owners within 200 feet of the boundary of the affected <br />land must be notified of the proposed operation (Rule 1.6.2(1)(e). The applicant will need to notify the <br />BLM of the proposed operation and obtain a written waiver of their right to the 10-day comment period. <br />If the applicant is unable to obtain the written waiver, the decision due date will need to be extended an <br />additional 10 days from the date the BLM received the notice to allow for comments.
