Long <br />, <br />Greeley, CO 80632 Division Director <br />RE: Herman Feit Pit, Outstanding Compliance Issues, Permit No. M-77-522 <br />Dear Mr. Richardson: <br />The Division of Minerals & Geology has concluded that the reclamation cost and required bond <br />for the Herman Feit Pit will need to be revised due to your failure to demonstrate compliance <br />with the requirements of the Office of the State Engineer (OSE). Stipulation No. 1 of your <br />amendment application conditionally approved by the Mine Land Reclamation Board on <br />August 22, 1994 requires that you obtain the proper permits from the OSE concerning any <br />exposed groundwater at the site. The Division notes that we had requested your cooperation in <br />resolving outstanding water concerns in 1994 and again in 2000, pursuant to our 1/21)/2000 <br />inspection report. It is our understanding that your operation now has two (2) lakes ~Nith <br />approximately 30 acres of groundwater exposed after December 31, 1980 and that the OSE has <br />no application on file for a well permit, temporary substitute supply plan, or permanent water <br />augmentation plan for this operation. Please see attached correspondence and reque:lts for <br />compliance. <br />The Division will be inspecting your site soon to verify the volume of suitable and a~railable <br />backfill materials. Review of the mining and reclamation plan for the Herman Feit Pit indicates <br />an average lake depth of 30 feet. Assuming all 3,730 linear feet of shoreline have already been <br />backfilled and graded to the specified 3:1 and 2:1 slopes, there will be 1,377,522 cubic yards of <br />backfill material required to cover the exposed groundwater. As noted in the Division's <br />1/20/2000 inspection report, we will require a financial warranty adequate to cover tFle cost of <br />providing clean inert fill material and backfilling the pit to an elevation that is at least two (2) <br />feet above maximum groundwater elevation. We currently anticipate a cost of $10.00 per cubic <br />yard for imported and backfilled material. Hauling and backtilling costs for suitable. on-site <br />materials should be substantially less. <br />In cases such as these, it is the Division's practice to notify the landowner(s) of such pending <br />concerns.
