COG-850002 and COG=850003 <br />Rio Blanco County <br />Dear Mr. Lewicki: <br />On April 9, 1992 you received notification that your request for inactivation of the CDPS permits for these sites <br />was denied. The general permit which provides coverage for these facilities is due to expire on Tune 30, 1992. <br />We have not yet received a renewal application for the facilities listed above. Should a discharge occur after <br />expiration of the permit, it will be in violation of [he Water Quality Control Ac[ and the federal Clean Water Act. <br />Such a violation may result in enforcement action by the Water Quality Control Division. <br />Enclosed are renewal applications for the coverage under the general permit. if they are returned to the Division <br />6y June 30, 1942 there will be ao lapse of coverage. It should be noted that EPA finali2cd the Stormwater <br />Regulation on November 16, 1990. This regulation requires coal mines to be covered by a permit which addressed <br />stolmwater discharges until hood release. The Division has modified the general permit to accomplish such <br />coverage. Therefore, by reapplying for coverage under the general coal mining permit, you also comply with the <br />requirements of 40 CFR Part 122.26. <br />We anticipate receipt of your renewal application in the near furore.
