This outfall will serve
as an alternate discharge for pond 007 and will be used for irrigation purposes on mine property. We have
determined that this outfall does no[ need Division authorization. On this basis, no change to your permit is
necessary.
Since the water referred to in your letter is water that has been discharged through authorized discharge point 007
to Calamity Draw, then pumped to land for irrigation purposes, it is a discharge to groundwater. Under section
6.15.2 (a) of the Reeulations for the Slate Discharge Permit System, [he Division of Minerals and Geology is the
"implementing agency" for regulating discharges to groundwater from mines that it permits. The Water Quality
Control Division does not have authority over such discharges.
Please contact me a[ (303)+692-3605 if you have questions.
Sincerely,
~Jbh C.
