Simpson, P.E. <br />State Engineer <br />This letter is in response to the application of February 25, 2000 requesting a substitute <br />water supply plan (SWSP) for a sand and gravel pit to be operated by Asphalt Specialties <br />Company, Inc. (Applicant) in accordance with §37-90-137(11) C.R.S. The Applicants shall be <br />responsible for compliance with this plan, but the State Engineer's Office may also pursue the <br />landowner, for eventual compliance. The required fee of $1,343 for the substitute water supply <br />plan has been paid. <br />This plan describes the proposed water uses for 2004 and 2005. The proposed plan <br />anticipates a maximum annual net depletion of 19.5 acre-feet for up to 2.18 acres of <br />groundwater exposed in a dewatering trench and sediment pond. No groundwater was <br />exposed within the permit boundary prior to January 1, 1981. <br />You have provided a monthly breakdown of the maximum annual depletions totaling <br />5.96 acre-feet of evaporative loss from a maximum of 2.18 acres of exposed groundwater, 0.53 <br />acre-feet of water used and consumed for dust control, and 13.01 acre-feet of water lost with <br />442,113 tons of mined product. No phreatophyte credit has been applied to this plan. <br />This plan anticipates dry mining of the Speer Mining Resources Pit by dewatering. The <br />operator has obtained a bond in the amount of $678,169 to cover the cost of remediation, <br />including lining and/or backfilling the pit in the event the operator walks away from the project <br />and/or allows the dewatering operation to discontinue. <br />The proposed source of replacement for this pit is from 20.48 acre-feet of fully <br />consumable efFluent leased from Consolidated Mutual Water Company (Consolidated Mutual). <br />The Consolidated Mutual water will be released from the Metro Wastewater Treatment plant, <br />which is located approximately 10 miles upstream of the operation. A 0.5 percent per mile <br />transit loss (5 percent overall loss) has been accounted for in the replacement. The monthly <br />depletions and replacement requirements are found on the attached Table 1. <br />
