This is in response to your consultant's, Mr. Thompson, letter dated October 27, 2003, in which he reported a noncompliance
with total suspended solids (TSS) and total iron effluent limits due to rain events at Outfalls 007A and OOSA, Mr.
Thompson's letter described the ponds as being properly maintained and operational prior to the rainfall. Rainfall was
recorded at the mine site the afternoon of the dischazges. Sampling was conducted on August 29, 2003 for Outfa11008A and
September 5, 2003 for Outfall 007A. A ten-yeaz, 24-hour event at New Elk Mine is approximately 2.9 inches. Your
sediment ponds are designed to contain a 10-yeaz/24-hour precipitation event. The self-monitoring data you provided on
your Discharge Monitoring Report is shown below:

dischazge from Outfa11007A and 008A was beyond control. Therefore, we believe that Pickewire Processing. LLC qualifies
for the less than or equal to a 10-year/24-hour precipitation alternate limit, thus waiving total suspended solids and total iron.
