Rainfall was
recorded at the mine site the afternoon of the dischazges. Sampling was conducted on August 29, 2003 for Outfa11008A and
September 5, 2003 for Outfall 007A. A ten-yeaz, 24-hour event at New Elk Mine is approximately 2.9 inches. Your
sediment ponds are designed to contain a 10-yeaz/24-hour precipitation event. The self-monitoring data you provided on
your Discharge Monitoring Report is shown below:
Reported ~ Permit
Period Outfall Parameter Results Conditions
3Q03 007A TSS, (mg/1) 150 (30 day avg) 35 (30 day avg)
3Q03 007A TSS, (mg/1) 150 (daily mx) 70 (daily mx)
3Q03 007A Iron, Total (mg/I) 12.1 (30 day avg) 3.5 (30 day avg)
3Q03 007A Iron, Total (mg/1) 12.1 (daily mx) 7.0 (daily mx)
3Q03 008A TSS, (mg/1) 97 (30 day avg) 35 (30 day avg)
3Q03 008A TSS, (mg/1) 154 (daily mx) 70 (daily mx)
3Q03 OOSA Iron, Total (mg/1) 29.35 (30 day avg) 3.5 (30 day avg)
3Q03 008A Iron, Total (mg/1) 30.00(daily mx) 7.0 (daily mx)
Picketwire Processing LLC has demonstrated that discharge occurred within 48 hours after measurable rainfall and that
dischazge from Outfa11007A and 008A was beyond control. Therefore, we believe that Pickewire Processing. LLC qualifies
for the less than or equal to a 10-year/24-hour precipitation alternate limit, thus waiving total suspended solids and total iron.
