Simpson, P.E. <br />State Engineer <br />We have received your December 12, 2002 letter requesting a substitute water supply <br />plan for the above referenced quarry operated by Agile Stone Systems, Inc. (Agile). This request <br />is submitted pursuant to C.R.S. 37-92-308(4), referencing the plan for augmentation applied for <br />in case no. 02CW131. Notice has been provided to the objectors in case no. 02CW131, and <br />no comments have been received from those objectors within the 30-day comment period. <br />The quarry does not expose ground water. Water is pumped directly from the Arkansas <br />River for product washing and dust control use. Consumption occurs by retention on product <br />(4% by weight of product washed), dust control (as metered), and evaporation off of a 2 surface <br />acre pond into which slurry from the wash plant is discharged. Net evaporation off of the pond <br />is based on the rates given on your Table 1 (copy attached). That portion of the water <br />discharged into the pond that does not evaporate is estimated to percolate back to the river on <br />the following schedule: <br />Percent return Month <br />73% Within the month discharged <br />22% In the 1 S` month following discharge <br />5% In the 2nd month following discharge. <br />A year round operation of 500,000 tons of production would result in depletions totaling <br />approximately 33 acre-feet. <br />The sources of replacement water are first 50 acre-feet of totally consumable water <br />leased (for a period of 10 years) from the Board of Water Works of Pueblo, and secondly, if <br />needed, 5 shares of Twin Lakes Reservoir and Canal Company stock that are owned by Agile. <br />Due to the current drought, Pueblo is currently meeting its contract by providing <br />available return flow waters. The possibility exists that this source of replacement water may <br />become inadequate for this plan, either by unavailability from Pueblo or inability to exchange <br />water upstream. In order to assure that that there will be sufficient replacement waters to cover <br />
