BOX 53 Executive Director <br />Saguache, CO 81149 Ronald w. cottony <br />/ / Atting Division Director <br />Re: Mask Ranch Gravel/Pit, File No. M-2002-0/8~/, Receipt of li0 Construction Materials <br />Reclamation Permit Application Package <br />Dear Mr. Scanlon: <br />On August 13, 2002, the Division of Minerals and Geology received your the 110 Construction Materials <br />Reclamation Permit Application package for the Mask Ranch Gravel Pit, File No. M-2002-087. Preliminary <br />review of the information received determined that the following items must be received before the Division can <br />consider your application as being submitted and technical review can begin: <br />EI~IIBIT G -Source of Legal RiPad-to-Ermter (Rule 6.3.71: Provide a description of the basis for <br />legal right of entry to the site and to conduct mining and reclamation. This may be a copy of access <br />lease, deed, abstract of title, or a current tax receipt. A statement by the Landowner and acknowledged <br />by a Notary Public stating that you have the legal right to ewer and mine is also acceptable. <br />EDIT J -Proof of Mailing, Notices of Permit AooGcation (Rule 6.3.10E Include proof of <br />mailings of the "Notice of Permit Application" sent to the Board of Supervisors of the local Soil <br />Conservation District, in the application, by submitting the dato-stamped receipt for Certified Mailing <br />or adate-stamped copy of the notice form with signature acknowledging personal service and receipt <br />by the appropriate board. Also, refer to Rule 1.6.2(1)(a). <br />E2+;IIIBIT L - Permane~ Man-Made Structures (Rule 6.3.12): You must provide information <br />sufficient to demonstrate that the stability of any structures located within two hundred (200) few of <br />the operation or affected ]and will not be adversely affected. If the Office determines that such <br />information is inadequate in demonstrate that the operation will not adversely affect the stability of any <br />significant, valuable or permanent man-made structure, the Applicant shall either. <br />(a) provide a notarized agreement between the applicant and the person(s) having an <br />interest in the structure, Umat the applicant is to provide compensation for any damage to the strucdue; <br />or <br />(b) where such an agreement can not be reached, the applicant shall provide an <br />appropriate engineering evahration that demonstrates that such structure shall not be damaged by <br />activities occurring at the mining operation. <br />
