McArdle
Mined Land Reclamation
723 Centennial Building
1313 Sherman Street
Denver, CO 80203
Dear Mr. McArdle:
MINED LAND RECLAMATION
Colo. Dept. of Natural Resources
This letter is in reply to a letter dated February 21, 1980 as sub-
mitted by The New Cache La Poudre Irrigating Company and The Cache La
Poudre Reservoir Company.
TO WIT:
The Three Bells Ranch Associates do hereby take strong exception to
the contents of said letter. It is the opinion of Three Bell that the
statement about the water table is not a true statement.
When I talked with John Lindeburg and Roy Johnson they stated they
had not talked with Dan Bell and they further stated that they had written
a letter of apology to Dan Bell. Roy Johnson further stated he had not
made an on site inspection and he therefore should not have written the
letter.
Dan Bell came to Three Bells office immediately upon having received
a copy of the letter, which I mailed to Mr. Bell. Dan Bell said he had
made no stater,~ents about the water table in the area of proposed
gravel extraction. Dan Bell did further agree that a family sedan could be
driven over the complete area at any time irrigation water was not being
applied to farm crops and pasture grass.
Both Roy Johnson and John Lindeburg stated the letter from said Cache
La Poudre was instigated by a neighbor of Three Bell, Robert Ochsner, who
is on the board of directors of Cache La Poudre. There have been problems
between said board member and Three Bell which are completely unrelated to
the extraction of gravel. The letter dated February 21, 1980 was a cheap
shot made without Robert Ochsner having given careful thought to the poss-
ible con sequencies that might arise from the delay in the granting of said
gravel mining permit.
1520 EAST MULBERRY, SUITE 150 FORT COLLINS.
