Division Director <br />11783 State Hwy. 337 <br />Tijeras, NM 87059 <br />Re: Red Rock Plant & Limestone Mine, File No. M-2002-004, Receipt of 112 Construction Materials <br />Reclamation Permit Application Package <br />Dear Mr. McGill: <br />On January 18, 2002, the Division of Minerals and Geology received your 112 Construction Materials <br />Reclamation Permit Application package for the Red Rock Plant & Limestone Mine, File No. M-2002-004. <br />Preliminary review of the information received determined that the following items must be received before the <br />Division can consider your application as being submitted and technical review can begin: <br />APPLICATION FORM: ApplicanUOperator Name -Page 1, 3, and 7 are inconsistent. The <br />ApplicantlOperator Name must be consistent on ALL documents throughout the application and on the <br />bonding documents. If the Application is being submitted on behalf of GCC Rio Grande, Inc. than on <br />Page 3 of the Application form you need to change Rio Grande Portland Cement Company to GCC Rio <br />Grande, Inc. <br />Aaolica6on Form -Pace 5 and 6: Please complete Responsibilities as a Permittee section of the <br />Application form enclosed. <br />EXHIBIT N -Source of Leval Right to Enter (Rule 6.4.141: You must provide the source of your <br />legal right to enter and initiate a mining operation on the affected land. The .copy of the State Land <br />Board Lease and the 3 Warranty Deeds submitted all state that Rio Grande Portland Cement Corp. has <br />the right-to~nter the lands. GCC Rio Grande, Inc. must submit evidence that they have the right to <br />enter the lands to be mined. <br />EXffiBIT R -Proof of Filing with County Clerk and Recorder (Rule 6.4.18): You must submit an <br />affidavit or receipt indicating the date on which the entire soalication was placed with the local <br />County Clerk and Recorder. <br />EXHIBIT S -Permanent Man-Made Structures (Rule 6.4.19): You must provide information <br />sufficient to demonstrate that the stability of any struchues located within two hundred (200) feet of the <br />operation or affected land will not be adversely affected. The Division cannot accept the statement. that <br />GCC Rio Grande, Inc. will not adversely affect the stability of the Denver and Rio Grande Railroad. <br />
