Walther <br />Executive Director <br />Michael B, Long <br />Subject: Your Request 4°...Extend The Period For Public Comment On The Proposed Rio Grande Division Director <br />Portland Cement Plant For Another 70 Days" Io regard to A Permit Application Filed by GCC <br />Rio Grande, Inc., File Number M-2002-004 Red Rock Cement Plant and Limestone Mine <br />Dear Ms. Booth: <br />On April 23, 2002, the Division of Minerals and Geology (DMG) received your comment letter dated April 20, 2002. In <br />this letter you requested the comment period be extended another 70 days. <br />C.R.S. 34-32.5-114 (PROTESTS AND PETITIONS FOR A HEARING} THE COLORADO LAND <br />RECLAMATION ACT FOR THE EXTRACTION OF CONSTRUCTION MATERIALS. states the following: An <br />aggrieved person has the right to file written objections to and any person has the right to file written statements in <br />support of an application for a permit and to petition for a hearing. Such protests or petitions for a hearing shall be filed <br />with the board or office not more than twenty days after the date of last publication of notice made pursuant to section <br />34-32.5-112 (9). For good cause shown in such protest or petition documents, the board may, in its discretion, hold a <br />hearing pursuant to section 34-32.5-115 to determine whether the permit should be granted. The applicant shall be <br />notified within ten days after any objections are filed with respect to the application and shall be supplied with a copy of <br />the written objections:' <br />The above paragraph of the Act does not allow for extension of the public comment period. The DMG is bound by the <br />provisions of the Act and must conduct itself accordingly.
