Simpson, P.E. <br />State Engineer <br />This letter is in response to the application submitted in September, 2005, and resubmitted <br />in May, 2006, requesting approval of a substitute water supply plan (SWSP} to be operated by <br />Asphalt Specialties Co., Inc. ("ApplicanC) in accordance with Section §37-90-137(11), C.R.S. The <br />applicant shall be responsible for compliance with this plan, but the State Engineer's Office may <br />also pursue the landowner for eventual compliance. The required fee of $1,343 for the substitute <br />water supply plan has been paid. <br />Plan Operation <br />The Turnpike Mining Resource property has historically been used for grazing land and <br />gravel mining. A portion of the property was previously mined in the 1970's through 1990's. In the <br />1990's the site was reclaimed and the Colorado Division of Minerals and Geology Bond was <br />released. An augmentation plan executed with the District 6 Water Users Association currently <br />replaces depletions resulting from evaporation from the 30-acre ground water pond that currently <br />exists at the site. <br />This SWSP seeks to replace depletions resulting from new mining at the Turnpike Mining <br />Resource site. Upon completion of mining, the site will be reclaimed by installing a compacted <br />clay liner on excavation slopes to prevent groundwater seepage. The SWSP request described <br />the proposed water uses for the proposed nine-year life of the mine. Up to 0.86 acres of <br />groundwater maybe exposed within the permit area, including dewatering and recharge trenches <br />during the lwo-year term of this approval. <br />The pit will remain continuously dewatered until reclamation is completed. Water produced <br />from the dewatering process will be recharged to the aquifer through recharge trenches. The <br />recharge trenches are shown in attached Sheets 1-3 and are located at the same approximate <br />distance from Boulder Creek as the mining cell centroids. The trenches will be approximately 4 <br />feet wide and 5 feet deep and oriented approximately parallel to Boulder Creek. The recharge <br />trenches will prevent the need for extended replacement of lagged dewatering depletions when <br />the dewatering of the cells ceases. <br />
