The last day for public comment was July 23, 2004. We received letters of <br />objection to the application on June 30th and July 9th, 2004. Therefore, in accordance with Rule <br />1.7.1(3) these letters aze being forwazded to you. <br />The original decision date was September 9, 2004 (90 days from completeness-Rule 1.4.9(1)), <br />however, since there was an objection this matter must appear before the Mined Land <br />Reclamation Boazd for final approval or denial. Therefore, the decision date is automatically <br />extended but must be made within 120 days of completeness (Rule 1.4.9(3). Therefore, the new <br />decision date is October 9, 2004, however, this matter will be scheduled for the September 22-23, <br />2004 Boazd Meeting at which time a final decision is expected. Apre-hearing conference will <br />need to be scheduled prior to August 23, 2004, which is within 30 days of the last date for public <br />comment (Rule 2.7.1(c)). If the results of the pre-hearing conference indicate that the issues in <br />the objection letter aze not under DMG's jurisdiction, or the letter is withdrawn, a decision could <br />be rendered at an earlier date.
