Box 7900 <br />Salt Lake City, UT 84107-0900 <br />RE: Notice of Intent - Getty Coal Company, Hart Syncline Area, Moffatt <br />County -File No. CX-159-09 <br />Dear Mr. Ressler: <br />Your "Notice of Intent to Explore" was received by the Division on <br />July 17, 1985. The Division has reviewed the notice and has the following <br />comments. <br />1.) Your estimated reclamation cost of $22,778.00 is reasonable. An <br />acceptable reclamation bond for this amount must be received by the <br />Division before an "Acceptance of Notice of Intent" is issued. <br />2.) Your NOI is not complete until the Division receives a document <br />showing a current right of entry to explore. <br />3.) Due to the competitive nature of crested and pubescent <br />wheatgrasses, these species should not be used for re-seeding <br />disturbed areas. If these species are removed from the seed mix <br />the percentages of western, intermediate and slender wheatgrasses <br />can be increased to make up the difference. <br />4.) The Division will not release the reclamation bond until the <br />monitoring wells are properly reclaimed, or until another <br />responsible party takes over the responsibility of reclaiming these <br />wells. The Division cannot accept the statement in your NOI that <br />"Getty disclaims any long term liability regarding the final <br />abandonment of the monitoring wells. .". <br />Upon the resolution of these items, the Division will issue an "Acceptance of <br />Notice of Intent". <br />Please contact me if you have any questions or comments. <br />Sincerely, <br />Gregg R.
