Cottony <br />Division Director <br />Natural Resource Trustee <br />Listed below aze remaining adequacy review comments on the above-captioned Regular 112 Application <br />that will need to be resolved on or before the June 7, 2004 decision date. Therefore, please respond to <br />these remaining comments on or before June 7, 2004. Please be advised that your application may be <br />deemed inadequate and maybe denied on June 7, 2004 unless the following adequacy review items aze <br />addressed to the satisfaction of the Division. <br />6.4.4 EXHIBIT D - Minine Plan <br />4. The applicant has stated on page 12 that some imported inert material will be imported for recycling <br />purposes and that some of the excess inert material may be used as fill in the slopes. Prior to importation <br />and backfilling of such materials, the applicant will need to submit a signed affidavit certifying that the <br />imported materials are clean and inert, as defined in Rule 1.1(20). Please respond, <br />6.4.5 EXHIBIT E -Reclamation Plan <br />7. The applicant specifies on page 15 that there aze limited wetland areas associated with a spring on the <br />southwestern part of the site. The applicant has also indicated that once mining is complete the pit floor <br />will slope to the southwest so that drainage may enter the wetland area if runoff occurs. The Division <br />anticipates that the operator will use Best Management Practices (BMP's), as necessary, to control runoff <br />and minimize sedimentation during mining and reclamation. Please respond. <br />6.4.12 EXHIBIT L -Reclamation Costs <br />Based on maximum volumes of 13,500 cy topsoil, 10,000 cy overburden, and 40,000 cy inert recyclable <br />materials to be stockpiled on site during mining and reclamation, the Division has calculated a total <br />reclamation cost of $57,100.
