Box 15265 <br />Lakewood, CO 80215 <br />Re: Draft Settlement Agreement for Cessation Order C-88-017, Golden Eagle Mine <br />Dear Mr. Stout & Ms. Trumbly: <br />Enclosed you will find a draft proposed settlement agreement for Cessation <br />Order #C-88-017. This proposal is based on the assessment conference held in <br />our office on Tuesddy, June 28, 1988. At your request the conference was <br />continued until July 29, 1988, to accommodate your attempt to reach a joint <br />settlement with the three regulatory agencies involved. A proposed draft <br />settlement agreement was forwarded to Division Director, Fred Banta, for his <br />concurrence, as required by Rule 5.04.3(4)(c). Fred declined to concur with <br />this original draft proposed settlement agreement, instructing me to <br />reconsider several of the opinions contained therein. A copy of Fred's <br />memorandum is enclosed, in response to your request. <br />The enclosed draft settlement agreement relates both the original opinion and <br />my reconsidered proposal. I'm forwarding this draft in response to your <br />request. I am willing to reconvene the conference if you so desire. It would <br />be my intention to present the basis for my reconsideration and to allow you <br />and all other interested parties to participate. We would provide public <br />notice of the reconvened conference and notify all who attended the original <br />session. I am forwarding this draft to assist you in deciding whether you <br />desire the conference reconvened. <br />As I expressed earlier, it is our intention to maintain all of WFC's rights to <br />appeal. Please inform me of your preference regarding the reconvening of the <br />conference. If you decide to forego, I would issue a final settlement <br />agreement for your consideration. If you decide to reconvene the conference, <br />Jim Stevens will coordinate a date of mutual convenience and complete the <br />appropriate notification. <br />Sincerel ours, <br />es A.
