A review of our files shows that your Department of the Army
permit number 199200135 expired on August 1, 1997. The project
is proposed in two phases - Phase I being on the west side of the
river measuring 100'X800'X10' and Phase II on the east side
(currently the active channel) measuring 150'X1000'X10'. Fill
will involve discharge for a dike (650 cubic yards), riprap to
reinforce the bank, and a wire/rail sill to prevent headcutting.
The project is located at the Uncompahgre River within Section 2,
Township 44 North, Range 8 West, Ouray county, Colorado.
If you have or intend to do any work that requires the
discharge of dredged or fill material below the ordinary high
water (OHW) elevation of the Uncommpahgre River as of August 1,
1997, it will be necessary for you to apply for, and receive, a
permit to continue work below OHW elevation. Any discharge of
dredged or fill material below OHW after this date is in
violation of Section 404 of the Clean Water Act.
