Box 519 <br />Greeley, CO 80632 <br />RE: File No. M-97-058, Baseline Resource, 112c Decision Letter -Conditions, Financial and Performance <br />Warranty Request -Construction Material Operation <br />Dear Mr. Gregg: <br />On ]anuary 14, 1998, the Division of Minerals and Geology approved your 112c mining permit application. The <br />conditions to the approval are noted below: <br />Stipulation No. Description <br />1. The operator must do one of the following four options: <br />a. Provide an alternate reclamation plan which shows Phase 2 and 3 as groundwater <br />lakes. The operator will show evidence of compliance with the Office of the State <br />Engineer, Division of Water Resources for this end use prior to exposure of <br />groundwater in Phases 2 or 3. <br />b. Provide a design for the slurry wall done by a registered professional engineer. <br />This design will be incorporated into the permit as a construction quality <br />assurance plan and will be enforceable by DMG. Also, the Operator will provide <br />a monitoring program for construction of the slurry wall to assure it is constructed <br />according to plan and will provide a testing program to determine if the slurry <br />wall is constructed properly. The Operator will provide a financial warranty for <br />the amount of 25% of the construction cost of the slurry wall. No groundwater <br />in Phases 2 or 3 will be exposed prior to final construction of the slurry wall and <br />written acceptance of the construction and quality assurance/quality control report <br />by DMG. <br />c. Provide a financial warranty in the amount sufficient to backfill Phases 2 and 3 <br />with earthen and inert materials in the event that the slurry wall fails. No <br />groundwater in Phases 2 or 3 may be exposed until the financial warranty is <br />provided and approved by DMG. <br />
