Your <br />letter described increased temperatures that resulted in runoff from snowmelt. Colowyo's sediment ponds <br />are designed to hold a 10-year/24-hour event. Alternate limits were requested for a less than or equal to a <br />10-year/24-hour event for all the above-mentioned Outfalls. In your letter dated August 31, 1999, you indicated that the riser pipe prior to the discharge on April <br />12, 1999 was clogged. The condition of the pond prior to the event does not meet the requirements of an <br />upset condition. Therefore, TSS and Total Iron are in noncompliance. The Division considers these <br />violations to be significant in nature. Further failure to comply with the terms of your permit may result in <br />enforcement action by the Division, including the imposition of penalties, <br />
