This site is located near the Los Pinos <br />River in Section 14U, Township 34N, Range 7W, Latitude 37° 11' 54.8", Longitude 107° <br />35' 7.60"„ La Plata County, Colorado. <br />According to the wetland report, the western quarter of the property is jurisdictional <br />wetlands. The property also contains several lateral irrigation ditches, stock ponds, and <br />wetlands formed by irrigation practices. <br />A Department of the Army permit is required under Section 404 of the Clean Water <br />Act for the discharge of dredged or fill material within a waters of the US, including <br />wetlands. In addition, filling irrigation ditches that have the potential to convey pollutants to <br />a waters of the US, may also require a permit. <br />Since it appears that your property contains jurisdictional wetlands, this office <br />recommends that you implement a 100 foot buffer between the wetland azeas and your <br />mining activity to insure that your activity does not encroach into the wetlands. <br />This letter is not an approved jurisdiction determination. If your project requires a <br />permit, or will be located at a close proximity to the wetland area, you should contact this <br />office to verify the wetland boundary. The wetland boundary should then be surveyed and <br />its limits should be clearly marked during construction. <br />
