I appreciate your patience and <br />understanding. I hope to clarify Kathleen's letter dated April 5, 2001, and confirm <br />statements in your letter dated April 12, 2001. Any groundwater exposed prior to January 1, <br />1981, in this case 45.5 acres, can be used as a credit to offset an equal portion of the <br />augmentation requirements for any current or future ground water exposed within the permit <br />boundaries of the Greeley West Pit. Also, it does not matter whether the currently exposed <br />groundwater area includes the pre-1981 exposed groundwater area of 45.5 acres. A one- <br />for-one credit will be allowed anywhere within the original permit boundaries (a.k.a. original <br />permit area) as they were created under the DMG permit number M-77-081. Any <br />subsequent modification, whether increase or decrease, to those boundaries will not change <br />the original permit area within which the credit can only be applied. This issue is the current <br />interpretation of SB 89-120 by the State Engineer.
