The <br />modification provides for an additional Outfall 019 to the Oxbow Mining LLC (OMLLC) CDPS <br />permit. <br />OMLLC is currently revising the Colorado Division of Minerals and Geology (CDMG) Coal <br />Mining and Reclamation Permit (C-1981-022) to provide for the installation of the new "Hubbard <br />fansite". The Hubbard fansite facility consists of a graded pad area, fanshaft, fan housing, <br />substation, topsoil stockpile and access road containing approximately 3.2 acres of additional <br />surface disturbance. Surface drainage from the project is designed to be routed to "Pond F." Pond <br />F will be designed and operated in accordance with applicable CDMG regulations for coal mine <br />sedimentation ponds. <br />The Pond F outfall will be Outfall 019 to the CDPS discharge permit. Please see the attached <br />map for the location of the site. <br />Oxbow Mining owns the surface area associated with the Hubbard fansite and the site is already <br />located within the current CDMG OMLLC permit area. The entire disturbed area and pond is also <br />included in a portion of the reclaimed Blue Ribbon underground coal minesite currently permitted <br />under a different CDMG permit (C-1981-047) and CDPS permit (COG-85-00009). Pond F was <br />formerly Outfall 002 in the Blue Ribbon CDPS permit It is important to note that the Hubbard <br />fansite will utilize an existing permitted disturbance area and existing pond and will result in little <br />additional "new" disturbance. <br />Once OMLLC has concluded the CDMG and WQCD permitting activities, it is our understanding <br />that MINREC, Inc., the operator of the Blue Ribbon mine. will promptly present permit revisions <br />to remove the liabilities associated with the Hubbard fansite acreage and Pond F from the Blue <br />Ribbon Mine CDMG and WQCD permits. <br />The construction of the Hubbard fansite is expected to begin in early 2005 with the ventilation fan <br />being fully operational by June, 2005. <br />.
