Simpson, P.E. <br />State Engineer ' <br />This letter is in response to your application of February 1, 2005 requesting a substitute <br />water supply plan for a sand and gravel pit owned by Raindance Aquatic Investments, LLC <br />(Applicant) and operated by Connell Resources. The required fee of $1,343 for the substitute <br />water supply plan has been paid. <br />This plan describes the proposed water uses through April 2007 for this new mining <br />operation. The proposed plan anticipates a maximum year net depletion of 27.45 acre-feet for <br />up to 0.2 acres of exposed groundwater surface as identified in the attached Table 2. Because <br />this is a new mining operation, no groundwater was exposed within the permit boundary prior to <br />January 1, 1981. <br />This current plan anticipates dry mining of the Raindance River Gravel Pit by dewatering. <br />The operator proposes to continuously dewater and dry mine the site. The operator proposes to <br />install a clay liner concurrent with mining as a means to create an off-channel reservoir for water <br />storage upon reclamation. The operator has obtained a Division of Minerals and Geology bond to <br />cover the cost to line or backfill the pit in the event the operator walks away from the project <br />and/or allows the dewatering operation to discontinue. <br />You have provided a monthly breakdown of the maximum annual depletions totaling 0.5 <br />acre-feet of evaporative loss from a maximum of 0.2 acres of exposed groundwater, 4.8 acre- <br />feet of water used and consumed for dust control, and 22.1 acre-feet of water lost with the <br />mined product. Lagged depletions for the terms of this approval are as follows: 13.62 acre-feet <br />for 2005, 23.32 acre-feet for 2006 and 5.16 acre-feet for 2007 as identified in the attached <br />Table 3. No phreatophyte credit has been applied to this plan. <br />The mining operation is located more than 100 feet from the Cache La Poudre River. The <br />applicant has provided a monthly schedule of lagged depletions to the river system resulting from <br />the operational losses at this site. Due to the lagged timing of depletions, replacement obligations <br />will continue after active mining at this site has been completed and subsequent substitute water <br />
