a, MLR-CP/SO-5/77 • • III III III IIIIIIIIII <br />sss <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />In the Matter of ) <br />C O N S E N T A G R E E M E N T <br />MOUNTAIN MOBILE MIX ------- --------- <br />Pursuant to the Resolution Concerning Compliance Plans for Unpermitted <br />Operations adopted by the Mined Land Reclamation Board on February 22, 1977, <br />the Board and MOUNTIN MOBILE MIX hereby enter into the following <br />agreement: <br />In consideration of MOUNTIN MOBILE MIX 's compliance with the requirements <br />of the above-cited resolution and the cease and desist order issued thereunder, <br />the Board hereby agrees to afford to MOUNTAIN MOBILE MIX the benefits of the <br />above-cited resolution. <br />In consideration of the benefits conferred by the above-cited resolution, <br />MOUNTAIN MOBILE MIX hereby consents to the following conditions: <br />1. Submittal of a permit application for the operation indicated <br />on the listing submitted to the Board on April 27, 1977 on or <br />before July 1, 1977; <br />2. If the Board denies the permit for this operation, the operation <br />shall cease as of the date of the denial. <br />3. If a permit is not granted for this operation by July 1, 1978, <br />cease the operation unless the time period for the granting of <br />the permit is further extended by Board resolution. <br />4. Be bound by the terms of the cease and desist order issued by <br />the Board on May 24, 1977 for this operation. <br />5. Waive the statutory time periods established for the issuance <br />of permits by Article 32 of Title 34, C.R.S. 1973, as amended <br />for the permit to be obtained on this operation. <br />6. By July 1, 1977, post bond or other form of acceptable surety of <br />general application guaranteeing the submission of a permit application <br />and the undertaking of reclamation on this operation in the amount <br />of $2,500.00. <br />
