There are only a couple of items that need to be <br />addressed in order to meet the requirements of the Mined Land <br />Reclamation Act and the Mineral Rules and Regulations. <br />1) Paragraph 2 of Exhibit D states "the maximum <br />gradient of the reclaimed slopes will be 20~". <br />This is a 5:1 slope. But the revised map you <br />sent shows a 3:1 slope. Which is correct? <br />2) Does the operator intend to mine the permit <br />area at a 3:1 (or 5:1) slope or will the <br />highwalls be mined at a near-vertical slope <br />then graded to 3:1 (or 5:1) after mining <br />ceases? <br />3) Paragraph 3(d) of Exhibit D says "the seeds <br />will be broadcasted". Can the operator not use <br />a tractor-drawn drill? If not, please explain. <br />I have enclosed a copy of two preliminary analyses of the financial <br />warranty bond requirement. As noted, for a situation where the <br />operator mines the pit with a near-vertical highwall (and a SO-foot <br />depth) the estimated reclamation costs are $50,682 (the major cost <br />is $33,291 for reducing the highwalls from 1:1 to 3:1 slopes). If <br />the operator mines the pit with 2:1 highwalls, the estimated <br />reclamation costs are reduced to $31,016. <br />As you can see, it is important to devise a mining plan that will <br />reduce the bond requirement. Also, the operator must explicitly <br />comply with whatever mining and reclamation plans chosen. <br />
