Long <br />Division Director <br />On July 24, 2001 the Division received a letter from the applicant's consultant, waiving Roaring <br />Forks Resources rights to n staff recommendation on August 3, 2001, and the 120-day permit <br />decision, presently scheduled for the August Mined Land Reclamation Board (MLRB) meeting. <br />The letter also requested that any future hearings required for the review and approval of the <br />application be scheduled so that this matter may be on the MLRB agenda for its September 19- <br />20, 2001 meeting. In response to this request the Division has tentatively rescheduled the Pre- <br />hearing Conference for September 12, 2001, at 1:30 p.m., in the Rifle City Hall. <br />As required by Rule 2.7.1 of the Construction Materials Rules and Regulations: <br />1) At the Pre-hearing Conference, the Pre-hearing Conference Officer shall cause to be <br />proposed a draft pre-hearing order. The draft pre-hearing order shall provide the <br />following: <br />a) n list of the parties' names, addresses and phone numbers; <br />b) a list of issues to be discussed at the Bonrd hearing; <br />c) an outline of the agenda for the Board hearing and allowed times for <br />presentations, crass-examination by parties and closing statements; <br />d) a fist of each party's witnesses; and <br />e) a list of each party's exhibits or documents to be used as evidence. <br />t ~y <br />OF COLORADO <br />2) The draft pre-hearing order shall be delivered to all parties to the hearing at least three <br />(3) days prior to the Board hearing. <br />
