We hope this letter will clarify the remaining issues holding up final <br />approval. We have commented on the remaining issues as they aze ordered in the second <br />adequacy review letter. <br />Mining Plan <br />A. Connell has gone through Larimer County's Concept Technical Review stage and the <br />preliminary Special Review stage. Thus faz, the County has not objected to the proposed <br />mining setback along County Road 36. If necessary, the Board of County <br />Commissioners final resolution will be submitted to the DMG as proof of acceptance of <br />the setbacks. <br />Enclosed is a copy of a signed letter from Grant allowing mining within 200 feet of his <br />buildings and irrigation ditch. <br />Enclosed is a copy of a letter from the Box Elder Ditch Company allowing mining within <br />200 feet of the Arthur Lateral. This letter also gives Connell permission to build an <br />access road over the ditch. <br />B. Enclosed is a copy of the Stormwater Management Plan with the "Best Management" <br />practices. <br />We aze unaware of the complaints from azea well owners.
