My clients, Bennie and Thelma Kobilan, own property in the <br />immediate vicinity to the proposed mine, just southeast of it. <br />The area in which the mining activity is proposed is dry and windy, <br />and the mining activity will result in considerable blowing dirt, <br />sand, and dust for a period of many years, which will affect the <br />Kobilans' property, reduce its value, and adversely impact the <br />grass and the stock grazing on it. It will generally degrade the <br />environment of the surrounding area, contributing to haze and air <br />pollution, and it will be a visible eyesore for the area. <br />As E1 Paso County grows, population pressures will cause the <br />surrounding area to be developed into low-impact, 40 acre <br />ranchettes. In fact this is already the case. The presence of <br />active, surface, mining will make the area undesirable for <br />continued development, due to noise, dust, and air pollution, and <br />it will create a health hazard for those animals and humans who <br />have to breathe the dust it spreads in the area. <br />The duration of the proposed mine, until the year 2040, exceeds the <br />lifetime of most adults of this state, and it is grossly <br />unreasonable. There is no lack of active clay pits in this state, <br />which would create an emergency situation justifying the <br />development of this mine. There can be no reasonable assurance <br />that the mining company will still be in business at the expiration <br />of the permit, or that the property will ever be reclaimed. The <br />most likely result, if the requested permit is issued, is that this <br />mine will forever remain a permanent blight upon the land, scarring <br />it for centuries to come. <br />In addition, the environmental analysis fails adequately to address <br />the affect on the wildlife and domestic grazing animals due to the <br />
