Long <br />Subject: Your Request "...The Comment Period Be Extended To 120 Days" In regard to A Permit Division Director <br />Application Filed by GCC Rio Grande, Inc., File Number M-2002-004 Red Rock Cement Plant <br />and Limestone Mine <br />Dear Mr. Smyer: <br />On Apri123, 2002, the Division of Minerals and Geology (DMG) received your comment letter dated April 21, 2002. In <br />this letter you requested the comment period be extended to 120 days. <br />C.R.S. 34-32.5-114 (PROTESTS AND PETITIONS FOR A HEARING) THE COLORADO LAND <br />RECLAMATION ACT FOR THE EXTRACTION OF CONSTRUCTION MATERIALS. states the following: An <br />aggrieved person has the right to file written objections to and any person has the right to file written statements in <br />support of an application for a permit and to petition for a hearing. Such protests or petitions for a hearing shall be filed <br />with the board or office not more than twenty days after the date of last publication of notice made pursuant to section <br />34-32.5-112 (9). For good cause shown in such protest or petition documents, [he board may, in its discretion, hold a <br />hearing pursuant to section 34-32.5-115 [o determine whether the permit should be granted. The applicant Shall be <br />notified within ten days after any objections are filed with respect to [tte application and shalt be supplied with a copy of <br />the written objections." <br />The above paragraph of the Act does not allow for extension of the public comment period.
