Dept. of Natural f?eso::rceG <br />Please refer to the application to you by Valco, Incorporated, <br />P.O. Box 550, Rocky Ford, Colorado, 81607, to conduct a surface <br />mining operation for sand and gravel on lands located just west <br />of Pueblo, Colorado, along the Arkansas River Valley. The <br />anticipated permit covers lands in Sections 31, 32, and 33, of <br />Township 20 South, Range 65 West, Sixth Principal Meridian, and <br />in Sections 5 and 6, of Township 21 South, Range 65 West, Sixth <br />Principal Meridian, Pueblo County, Colorado. <br />We received a letter of notification from Valco, Incorporated, <br />dated January 16, 1978, concerning their application, mentioning <br />that pertinent comments concerning the application should be made <br />to your office. Part of the lands covered in the application are <br />adjacent to or across the Arkansas River from lands purchased by <br />the United States for Pueblo Reservoir. Our affected lands lie <br />in the SE 1/4, Section 31, Township 20 South, Range 65 West. <br />We have the following comments that we feel should be incorporated <br />as stipulations in the permit for mining the lands in question: <br />1. The licensee should be prevented from such construction <br />which will cause the river to rechannel on adjacent owners. <br />2. Since the United States has a substantial interest in the <br />trackage and rights-of-way for the railroad traversing the area <br />listed in the application, we request a stipulation that such <br />rights-of-way, trackage, and appurtenances shall in no way be <br />jeopardized by any mining or construction. <br />A marked print of part of the Northwest Pueblo, Colorado, quadrangle <br />sheet is enclosed for your convenience. <br />
