You are strongly advised to <br />consider the information herein, and respond prompt y. ai ure to o so will <br />result in action by the Mined Land Reclamation Board, and such action may lead <br />to civil penalties. <br />1. The Division's inspection of 2/26/91 noted a problem with records and <br />processing facilities. The asphalt (hot mix) plant which now lies on the <br />property is not addressed in the original permit. You were instructed in <br />the inspection report to submit a Technical Revision to the Division by <br />April 26, 1991, describing the plant and the location of the plant in the <br />pit. We have not received a technical revision. <br />2. The Division's inspection of 2/26/91 also noted a problem with financial <br />warranty. You were instructed in the inspection report to add E2500 in <br />financial warranty by August 26, 1991, or convert your operation to a 112 <br />permit and submit the additional financial warranty with the conversion <br />application. We have not received the additional financial warranty nor <br />the 112 Conversion Application. <br />Page 2 of the inspection report notes: "The possible violations should be <br />corrected by the dates given, or they will become possible violations." <br />Please know that "possible violations" differ from "problems" in that problems <br />arc' addressed by the t4ined Land Reclamation Division whereas "possible <br />violations" are addressed by the Mined Land Reclamation Board. The "possible <br />violations" are potentially more serious because they require the board to <br />consider civil penalty. By failing to respond to the noted problems by the <br />dates given in the inspection report, we have reason to believe that you are <br />in violation of the conditions of your reclamation permit. <br />
