Traxler; <br />We appreciate the opportunity to review the responses of the interested <br />parties in regards to the above application. <br />In response to the letter from the Division of Wildlife, we wish to make the <br />following comments. We feel that the intent of the Easement for Hunting, <br />Fishing and Other Recreation was to allow general access of the public to <br />the Frank property for these purposes and in no way was intended to sub- <br />stantially restrict or reduce the owners beneficial use of the property. <br />The subject tract is a minumum of approximately 900 feet North of the Cache <br />La Poudre River channel and no work will be done in the channel or within the <br />25 feet cited in Paragraph 5 of said Easement Agreement. The tract will be <br />fenced during the mining operation for safety reasons and then the fence will <br />be removed Only 30 feet of the perimeter of the Frank property will be <br />fenced and less than 3 percent of the easement acreage temporarily removed <br />from easement use. <br />The applicant fully intends to operate within the law and any other duly <br />imposed limitations and restrictions and will obtain necessary permits from <br />all Local, County, State and Federal agencies. <br />The last sentence in the second paragraph of the Application and Report is <br />incorrect and should read - The tract of land and the created pond will be <br />returned to the use of the owner with the previous Easement for Hunting, <br />Fishing and Recreation to remain in effect. <br />1 ~~' <br /> <br />
