• • III IIIIIIIIIIIII III <br />999 <br />Agenda Item #~-{~~ <br />Pueblo Coal, Inc. (PCI) <br />C-82-054 <br />A. Personal Intro <br />B. We scheduled this session to discuss two issues concerning Pueblo Coal <br />Company's Carbon Junction Mine. The first issue pertains to a letter of <br />agreement between the Division and Pueblo Coal signed December 14, 1989, <br />(Ex. A) and endorsed by the Board at the December Board meeting. The <br />X agreement ands Board Order (Ex. B) required PCI to comply with <br />certain permit renewal deficiencies by June 1, 1990. The order further <br />specified that the Division would recommend denial of the renewal <br />application and schedule a formal hearing before the Board in June, if <br />conditions of the letter were not met. Pueblo Coal has requested the <br />opportunity to address the Board regarding this matter today, Additional <br />background is provided in Exhibits C and D. (Division's Proposed <br />Na~'on5a^ <br />Decision to Deny Renewal Application and Newspaper Publication of-~191c,~10 <br />& 17, 1989). <br />The second issue~wh ci h the Division wishes to make the Board aware o~ <br />concerns the status of the Letter of Credit Reclamation Bond we currently <br />hold for the Carbon Junction Mine, Letter of Credit # 17345 - issued by <br />the Texas American Bank of Ft. Worth, Texas, in the amount of 5931,150.00 <br />(Ex. E). <br />
