Box 625 <br />Lyons, Colorado 80540 <br />Re: Andesite Rock Company/Lyons Quarry <br />Pmendment - File No. 77-141 <br />Dear Mr. Staebell: <br />At the December 15, 1963 rneetiny of the Mined Land Reclamation Board, the <br />Board took the following two actions concerning the above proposed <br />amendment: <br />1. Directed both parties together with legal counsel to attend and <br />participate in a Pre-Formal Nearing Conference to identify items to De <br />considered at the Formal Hearing. <br />2. Granted a request submitted by Mr. Karl F. Kumli III, Attorney for <br />Hallyn F. Hall, Landowner that a Formal Public Hearing be held pursuant <br />to Section 114 and 115 of "The Colorado Mined Land Reclamation Act", <br />Article 32 of Title 34, C.R.S. 1973 as amended, which state in pertinent <br />part: <br />34-32-114. Protests and petitions for a hearing. Any person has <br />the right to file written objections to or statements in support of <br />an application for a permit with the Board. Such protests of <br />petitions for a hearing shall be timely filed with the Board not <br />more than twenty days after the date of last publication of notice <br />pursuant to section 34-32-112 (10). For good cause shown in the <br />protest or petition documents, the Board, in its discretion, may <br />hold a hearing pursuant to section 34-32-115 on the question of <br />whether the permit should be granted. The applicant shall be <br />notified within ten days of any objections to his application and <br />be supplied with a copy of the written objections. <br />34-32-115. Action by Board - appeals. (1) Upon receipt of an <br />application for a permit and all fees due from the operator the <br />Board shall set a date for the consideration of such application <br />not more than ninety days after the date of filing.
