Appendix C <br />Right of Entry and Operation Information <br />CAM Mining, LLC, bases its right to enter and begin surtace coal mining operations in the permit <br />area upon the following documents: <br />Deed and Assignment dated May 19, 2003, between Lodestar Energy, Inc. and lodestar <br />Holdings, Inc. and Central Appalachia Mining, LLC, "CAM". The Deed and Assignment <br />conveyed to Central Appalachia Mining, LLC, certain Fee Property, Federal Coal Leases, <br />Properly Rights, Private Coal Leases, Federal Non-mineral Lease and Rights of Way <br />and Water Rights along with other property rights. The Deed and Assignment follows as <br />Exhibit 1. The "Property" conveyed to Central Appalachia Mining by the Deed and <br />Assignment is discussed below. <br />a. Fee Property -None of the Fee Properly conveyed is applicable to the Munger <br />Canyon Mine. <br />b. Federal Coal Leases -Federal Coal Leases C-0125515 and C-0125516 are <br />within the Munger Canyon Mine permit boundary. The BLM approved <br />assignment of the Federal Coal Leases through its decision dated November 4, <br />2004. The BLM decision document and copies of the Federal Coal Leases follow <br />as Exhibit 1b. <br />c. Property Rights -The Easement Agreement effective April 11, 2007, between <br />#11 Enterprises, Ltd. and CAM Mining LLC, pursuant to which #11 Enterprises, <br />LTD. bargained, conveyed, delivered, transferred, granted and sold to CAM <br />Mining, LLC anon-exGusive Easement between State Highway 139 across the <br />private property of #11 Enterprises, Ltd. onto Bureau of Land Management land <br />in Munger Canyon. The Lease follows as Exhibit 1 c. <br />d. Private Coal Leases -None of the private coal leases are applicable to the <br />Munger Canyon Mine. <br />e. Federal Non-Mineral Lease and Rights of Way -Rights-of-Way COC36761 for a <br />existing transmission power line and COC30962 for an existing road are <br />applicable to the Munger Canyon Mine. The BLM decision document approving <br />the assignment of the Rights-of-Way and a copy of the Rights-of-Way follow as <br />Exhibit 1e. <br />f. Water Rights -None of the water rights conveyed are applicable to the Munger <br />Canyon Mine except and to the extent water is hauled to and consumed at the <br />Munger Canyon Mine. <br />2. A portion of the permit area is a reclaimed rail loadout site in Loma, CO. CAM's right to <br />enter the loadout area is granted by an Adoption Agreement entered into as of the 2nd <br />day of February, 2004, by and between the Union Pacific Railroad Company and Central <br />Appalachia Mining, LLC. The adoption agreement follows as Exhibit 2. <br />3. The BLM authorized the Operator to access and maintain ground water monitoring wells <br />located on BLM managed land outside of federal coal leases associated with the <br />McClave and Munger Canyon Mines.
