SU-93-14, Su-93-15 and V-93-8, and <br />CMLRB File No. M-93-041 <br />Dear Mr. Lohr: <br />This letter provides the supplemental information requested by <br />Boulder County staff regarding the ownership of certain reserved <br />mineral interests identified in a title report previously <br />furnished to the County in connection with Southwestern's permit <br />applications. These reserved mineral interests relate to <br />portions of the area within the proposed limestone mining and <br />reservoir permit boundaries at Dowe Flats. <br />A. Purposes of Report. The information presented in this <br />letter is responsive to Sections 19-205(1)(C) and 20-205(1)(C) <br />of the Boulder County Zoning Resolutions which request a permit <br />applicant to provide a title report identifying owners of <br />surface and subsurface estates in the land within the permit <br />boundaries (the "Land"). The Land consists of portions of <br />Sections 9, 10, 15, 16, 21 and 22 of Township 3 North, Range <br />70 West of the 6th Principal Meridian, Boulder County, Colorado, <br />and more particularly described in the referenced permit <br />applications. <br />B. Basis for Report. Southwestern has furnished to Boulder <br />County and the CMLRB a title report (the "Title Report") <br />issued by Security Title Guaranty Company, Commitment <br />No. G000729-3-A93, dated June 9, 1993, covering the Land. The <br />Title Report sets forth the ownership of the surface estate and <br />those portions of the mineral estate that are owned by the <br />owners of the surface estate.
