Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety has begun the review process for the above referenced <br />application. Please find enclosed a copy of the Pre-operational inspection conducted on May 31 s`, 2007. <br />A review of the application and a visit to the site indicate a few issues that need to be clarified or <br />corrected. Please address the following: <br />1) Please supply documentation and clarification on the agreement to extend the water line for the <br />stock tank to the north during final reclamation. <br />2) As indicated in our discussions, please confirm the commitment to clearly mark boundaries and <br />in particular the small triangular parcel between Phase 1 and 2. <br />3) Please note the Public Notice was incorrect in stating that comments must be received by June <br />5`h, 2007. Under the Rules, a 112c permit has 20 days past the last date of publication. The last <br />date was May 23'~ so 20 days is the 12`h of June. Since no comments have bean received, staff <br />will not require republication, however if any comments are received between the 5`h and 12`h <br />they must be considered timely. <br />4) Staff is asking all operators with asphalt plants to supply a plan for the periodical clean-up of <br />reject and over spill asphalt on site. Please submit a plan for the clean-up and disposal of reject <br />and overspill asphalt for this site. <br />5) It is noted that there are a few fences that do not have signed damage agreements attached. <br />Please supply the agreements, an engineering statement that excavation will not harm or disturb <br />the fences or a commitment to stay at least 200 feet away until such agreements or statements are <br />supplied. <br />6) Under the Reclamation Plan it is noted that "grading will leave the topography very similar to <br />Pre-mined conditions.
