Long <br />Denver, CO EiD216 Division Director <br />RE: Dahlia North Resources Pit, Cooley Gravel <br />Company, File No. H-94-093 <br />Dear Dave: <br />Please find enclosed the following documents related to the unresolved wildlife issues <br />at the above referenced pit: <br />1. Cooley Gravel's proposal (prepared by their consultant, Bob Fleming) dated January <br />11, 1995, that came in subsequent to the discussions held at our joint meeting at <br />Urban Drainage and Flood Control offices. <br />2. A list of concerns dated January 23, 1995 prepared by DMG which notified Cooley <br />Gravel that DMG did not consider the January 11, 1995 proposal to be adequate or <br />in keeping with the agreements reached at the joint meeting. <br />3. Cooley Gravel's response (again, through Sob Fleming), dated February 7, 1995, to <br />DMG'e listed adequacy concerns. ' <br />As I see it, the current shortcomings in the Cooley Gravel proposal are: <br />1. They have not committed to an undisturbed buffer zone adjacent to the river at the <br />northwest corner of the property, rather, they propose to install grade control <br />and riprap trench structures, and a slurry wall, within about 100 feet of the <br />river, within the wildlife habitat area. These installations would result in <br />significant damage to the wildlife habitat. <br />2. They have not agreed to double the originally proposed shrub plantings along the <br />river. <br />Please review the enclosed documents and provide me with your recommendations.
