Dear Mr. Laird:

The Division of Minerals and Geology has received your application for the Tumpike Mining
Resource, and reviewed the application for adequacy issues. The Division has also reviewed the
material hand delivered to Gregg Squire during the Pre-Operational site inspection on Apri129, 2004.
Since there are some outstanding questions concerning the reclamation costs, a final cost estimate is
not being provided at this time, but will be addressed later. The Division is required to make a
decision no later than May 18, 2004 therefore, your response to the following adequacy review
concerns should be received by the Division by May 13, 2004, in order to give the Division some time
to review the responses.
1. Exhibit B- Index Map
The main purpose of the index map is to assist the Division in locating the proposed site.
Please revise this exhibit by adding the appropriate street names and numbers to assist in
locating the site.
2. Exhibit D- Mining Plan
a) Under "Earthmoving" in this Section reference is made to a low water crossing. The
Division requires additional information to determine if the structure will cause any impacts
to the prevailing hydrologic balance and to assist the Division in determining the cost to
remove the crossing as part of Exhibit L-Reclamation Costs.
Please specify how the crossing will be constructed. In particular, please state;
1) The amount of topsoil to be salvaged and the location of the topsoil pile.
