LOng <br />D n~nion DVeUOr <br />Re: Notice to Backfill Pit with Offsite Material, Orchard Grove Industrial Park Pit, Permit No. <br />M-90-094. <br />Dear Mr. Parkerson, <br />This office itas received the above-named Notice, which was submitted by you as required <br />pursuant to Rule 3.1.5(9). I have reviewed the Notice, and find that it is complete and complies <br />with all the points in that rule. There are a couple of things which I hope you can clarify for the <br />record. <br />You stated in the Notice that backfilling will occur with the 10,000 cubic yards of offsite- <br />generated inert fill which are presently stored onsite (within the permit area). There is a <br />significant amount of additional inert fill, which appears to be of the same type, presently stored <br />immediately offsite on adjoining land also owned by you. (This was observed and discussed <br />during the 1/23/98 inspection.) Please state whether that material no~v offsite will at some point <br />be brought onsite, for immediate backfill or temporary storage prior to backfilling. <br />Also, please indicate whether the stated volume of 10,000 cubic yards of imported inert fill may <br />increase at any time during the future. When the bond is recalculated to include pushing backfill <br />material into the pond, it will reflect a specific volume of material. If the volume increases <br />substantially, and the increase is not covered by a bond, the State could face a reclamation <br />liability. <br />I am approving your use of the imported inert fill which was described in the Notice, and also use <br />of additional amounts beyond the 10,000 cubic yards presently onsite, as long as it is of the same <br />nature and utilized in the same manner. <br />Please note that, by your timely submittal of this Notice, the problem described in the 1/23/98 <br />inspection report is now abated. (I also look forward to the 1998 knap~veed control report you <br />will send to this office by 12/1/98.) <br />
